Buying Property in Spain
Can foreigners buy property in Spain?
Yes. Non-residents, including buyers from outside the EU, can generally buy property in Spain, subject to applicable requirements and any restrictions affecting the buyer or property. Ownership does not itself grant residence rights. NYLIA can help you find suitable homes and coordinate your search with an independent lawyer.
Do I need an NIE number?
Foreign buyers generally need an NIE (foreigner identification number) for tax and property-related formalities. Your lawyer can explain the application process and timing.
What extra costs should I budget for?
In addition to the agreed price, budget for applicable transfer tax or VAT and stamp duty, notary and land registry fees, legal advice and any mortgage-related costs. The mix depends on whether the property is resale or new-build and on current regional rules. Ask your lawyer for a property-specific estimate before committing.
How long does buying a property take?
Timing varies with the seller's documents, financing, due diligence and agreed completion date. A straightforward resale can often progress in weeks to a few months, while off-plan homes follow the development timetable. NYLIA can help coordinate viewings and communication among the parties.
Do I need an independent lawyer?
We strongly recommend using an independent Spanish property lawyer to review title, charges, licences, planning status, community obligations and contracts before you sign or transfer funds.
Can I buy remotely?
Some steps may be handled remotely, including through a properly drafted power of attorney, subject to identification, lender, notary and legal requirements. We can coordinate remote viewings, but your lawyer should confirm what can be completed without travelling.
New Developments & Off-Plan Properties
What does buying off-plan mean?
You commit to a property before construction is complete, using the developer's plans and specifications. Check the build programme, contract terms, planning permissions and the developer's track record with your lawyer.
Are stage payments protected?
Spanish law provides protections for qualifying advance payments on homes under construction, but the precise guarantees and their application must be verified for the specific project. Before paying, ask your lawyer to check the guarantee or insurance documentation and designated account details.
What if construction is delayed?
The contract should describe the estimated completion date, permitted extensions and remedies. Have your lawyer explain your rights and the evidence needed if deadlines are missed.
Can I change finishes or layouts?
Some developers offer personalisation within set deadlines and at additional cost. Request all options, specifications and agreed changes in writing.
How does NYLIA work with developers?
We can introduce selected developments, help compare locations and specifications, arrange viewings and liaise with developer sales teams. Buyers should still obtain independent legal advice and confirm availability, prices and terms directly in the transaction documentation.
Living on the Costa del Sol
Is the Costa del Sol suitable for year-round living?
Many international residents live here throughout the year. Consider commuting, school calendars, neighbourhood activity outside summer, healthcare access and your preferred lifestyle before choosing an area.
What schooling options are available?
There are Spanish public and private schools as well as international schools in the wider region. Admissions, languages, fees and transport differ, so contact schools directly and arrange visits where possible.
How does healthcare work for international residents?
Access depends on residence status, employment, insurance and other eligibility rules. Check your entitlement with the relevant authorities and compare private cover if needed.
Does buying a home give me residency?
No. Property ownership and immigration permission are separate matters. Spain’s investor residence route for new property-based applications ended in April 2025; transitional arrangements may apply to earlier applications and existing permissions. Your nationality and circumstances determine the options available. Consult a qualified immigration adviser.
Can NYLIA help with relocation?
We can provide local information and introduce independent professionals for services such as moving, schooling guidance, legal advice and home setup. Third parties provide and charge for their own services.
Choosing the Right Area
Marbella or Estepona: which is right for me?
Marbella offers established luxury neighbourhoods and a broad range of amenities; Estepona offers its own town character and a mix of established and newer residential areas. The right choice depends on your budget, travel patterns and preferred setting.
What is Nueva Andalucía known for?
Nueva Andalucía is popular for golf, villas, apartments and proximity to Puerto Banús. Individual communities differ considerably in privacy, walkability and outlook.
Is Benahavís part of Marbella?
No. Benahavís is a separate municipality. La Quinta, Benahavís, is close to Marbella, but should not be described as being in Marbella. Check the municipality of the specific property.
What should families compare when choosing an area?
School journey times, traffic, healthcare, activities, outdoor space, community fees and year-round convenience matter as much as the property itself.
Can NYLIA arrange an area discovery visit?
We can discuss your requirements and coordinate property viewings across suitable areas, subject to scheduling and property access.
Selling Your Property
How does NYLIA value a home?
We consider location, condition, features, current competing listings and relevant market evidence. An asking-price recommendation is not a formal bank or court valuation.
What documents will I need to sell?
Requirements vary, but sellers commonly need identity and ownership documents, property registry information, relevant certificates, community information and details of charges. Your lawyer should provide a property-specific checklist.
What costs and taxes apply when selling?
Potential costs can include agency fees, legal costs, municipal tax and tax on gains, depending on circumstances. Ask a tax adviser for an individual calculation before setting your net proceeds target.
How will NYLIA market my property?
We discuss positioning, presentation, suitable photography and distribution channels based on the property and agreed marketing plan. Specific portal placement or outcomes should never be assumed without confirmation.
Can I sell while living abroad?
Often yes, with appropriate legal representation and documentation. Your lawyer can advise on powers of attorney, tax formalities and completion arrangements.
Investors & Rental Property
Is Costa del Sol property a good investment?
It may suit some buyers, depending on their rental strategy, available capital and timeframe. Assess the purchase price, location, financing, ownership costs, regulation and eventual resale conditions. Neither rental income nor capital appreciation is guaranteed. NYLIA’s Investors service can help you compare properties and identify the information you need.
Can I use my Costa del Sol property personally and rent it out when I'm away?
Potentially, depending on the property and the proposed rental arrangements. Before purchasing, investigate applicable rental rules, community restrictions, licensing or registration requirements, management costs and likely demand. Your own stays also reduce the periods available for letting. Do not assume rental eligibility or income without verification.
Can I rent out my investment property?
Possibly, subject to applicable national, regional, municipal and community rules, as well as any licensing or registration requirements. Your independent legal adviser should verify what is permitted for the particular property and proposed rental model before you rely on rental income.
How should I assess a property's potential rental yield?
Start with documented rental evidence where available and realistic assumptions about occupancy and expenses. Gross yield compares annual rental income with the purchase price. Net yield takes expenses into account; any calculation should state which costs were deducted and what investment amount was used. Financing and taxes may further affect your outcome. Every projection is an estimate, not a promise of returns.
What ongoing costs should I model?
Include local property taxes, community fees, insurance, utilities, repairs, maintenance, management, financing, periods without tenants and applicable taxes. Villas with pools or gardens may have substantial upkeep costs. The assumptions should reflect the specific property and its intended use.
Can NYLIA help with the management of an investment property?
NYLIA can introduce property owners to independent specialists for rental management, maintenance and related services where available. Providers set their own scope, fees, terms and responsibilities under separate arrangements. NYLIA does not itself guarantee occupancy, rental income or third-party service performance.
Is a new development or a resale property better for investment?
Neither is automatically better. Compare the payment schedule, completion and handover risks, condition, potential rental permissions, running costs and any work required before occupation or letting. The choice depends on the specific property, your timeframe and intended use.
Does NYLIA provide investment or tax advice?
We help buyers research and compare property opportunities and can coordinate introductions to appropriate specialists. We do not replace independent legal, tax, lending or regulated investment advisers.
What should I check before buying a renovation project?
Ask qualified specialists to assess the structure, planning and permissions, likely costs, timescales and contingencies. Do not assume alterations can be approved or legalised. Your independent lawyer should review the relevant property documents.

Marbella Lifestyle & Amenities
What can I do beyond the beach?
The region offers golf, hiking, water activities, dining, cultural events and wellness experiences. Availability and seasonality vary.
Do I need a car?
It depends on your neighbourhood and routine. Some central areas are walkable, while hillside homes and many residential developments are more convenient with a car.
Is Puerto Banús the same as Marbella town centre?
No. Puerto Banús is a marina and commercial district west of central Marbella, with a different atmosphere and amenities.
Are golf properties only for golfers?
No. Buyers may value green views, open space and nearby facilities, but should assess course operations, maintenance, access and community costs independently.
Can NYLIA help me discover the local lifestyle?
We can help you get to know the area and introduce suitable external providers for selected experiences and practical services.
Luxury Villa Rentals
Can NYLIA help me find a luxury villa rental?
Yes. We can discuss your dates, group size, location and preferences, then introduce you to external rental specialists who may have suitable properties. Availability is subject to confirmation.
Can I rent while searching for a home to buy?
Yes. A temporary stay can help you test neighbourhoods and travel times before deciding where to purchase. We can coordinate your property search alongside partner introductions.
Who handles the booking, deposit and cancellation terms?
The independent rental provider is responsible for its own booking process, contracts, payments, deposits, cancellation policies and property operations. Review its terms before paying.
Are rental properties verified and legally compliant?
Licensing and legal obligations depend on the property and rental type. Ask the provider for applicable registration or licence details and have any concerns independently checked; NYLIA does not guarantee third-party compliance.
Can you help with longer stays?
We can contact rental partners to explore extended-stay options. Availability and contract conditions depend on the property and provider.

What concierge services can NYLIA help arrange?
Through external partners, we can help coordinate introductions for services such as private transfers, drivers, chefs, yacht experiences, housekeeping, wellness, furnishings and property care, subject to availability.

Can you arrange ongoing property management?
We can introduce independent property management providers where available. Their services, fees and responsibilities are governed by their own agreements.
